PRIVACY POLICY

Information is provided in accordance with a Regulation of the European Parliament and of the Council (EU) 2016/679 dated April 27, 2016 on the protection of individuals in the processing of personal data and on the free movement of such data, as well as on the repeal of Directive 95/46 / EC (General Data Protection Regulation) (Official Journal of the European Union, Series L for 2016 No. 119, p. 1), hereinafter referred to as GDPR:

          Data Administrator and its contact details

          Categories and sources of personal data

Depending on your relations with us, we can process the following categories of your personal data:

  • personal data (for example, name and surname),
  • contact details including business data (for example, legal address, phone number, email address, position of the contact person, name of employer),
  • identification data (for example, UNP, identification number in the Register of National Economy Entities),
  • information about our cooperation with you (for example, information about the contracts concluded with you or settlement details).

Personal data is mainly obtained directly from you, other sources are usually your employers, customers or public databases.

 

          Data processing

Your personal data is processed or may be processed by us:

  1. for the purpose of concluding and executing an agreement with you (first of all, a contract for transportation, forwarding, customs agency services, warehousing) or for responding to your request before concluding an agreement (including submission, consideration of proposals among them the commercial ones, etc.). Legal basis - Art. 6 cl. 1 b) GDPR);
  2. in order to comply with our legal obligations, such as the tax ones. Legal basis - Art. 6 cl. 1 c) GDPR;
  3. in order to implement our legal actions, such as:

          a) direct marketing of our products and services,

          b) provision of the information related to our products and services including the processing of your request regarding these products and services,

          c) verification of the counterparty credibility (including its solvency and compliance with the requirements for carriers / forwarders),

          d) fulfillment of a commercial contract if your data was transferred to Transgrouplogistic LLC by your employer in connection with the conclusion and execution of the commercial contract connecting your employer with us,

          e) for the purpose of suing or defending against lawsuits

The legal basis for the processing is Art. 6 cl. 1 f) GDPR);

  1. in the situations where you have given your consent – for the purposes specified by you in the agreement (legal basis - Art. 6 cl. 1 a) GDPR);

Your personal data provision is voluntary but necessary for the conclusion and execution of a contract, as well as for the contract actions. The data provision for the purpose of marketing is voluntary.

We will not make automatic decisions regarding you including the decisions arising from profiling.

 

          Data retention period

Your personal data will be stored only until it is necessary for the purposes set forth in this Privacy Policy (i.e., in particular, during the contract duration), and / or to satisfy legal requirements (for example, before the expiration of the data retention period arising from the tax law), and / or before the expiration of the claims under the lawsuit.

In case the data is processed on the basis of your consent, your data will be stored until the consent is revoked (if there are no other grounds for its processing and there are no exceptions provided for by the GDPR), and if the processing is based on our legal actions – until revocation of the processing permit for direct marketing purposes, or until objections arise due to your specific situation when our legal grounds for processing do not violate your legitimate interests, rights and freedoms or are not grounds for occurring, suing or defending against lawsuits.

          Data recipients

We can disclose your personal data to authorized employees and entities that are involved in our fulfillment of the contract (first of all, to the carriers that provide you with transportation services – if you were / are a customer for us, or to the customers you performed / perform transportation services for – if you were a contractor for us), as well as to the entities providing us with subcontracting, organizational, technical, legal and consulting services (for example, the entities providing accounting services, debt recovery companies). In a situation where it is necessary to achieve the above goals, including fulfilling the obligations established by law, your data can also be transferred to the regulatory authorities, courts and other state organizations (for example, tax authorities).

In connection with the provision of our transport and forwarding services, in some cases which are necessary for the fulfillment of a contract / order (for example, if you are our subcontractor in the provision of international transport services), to the minimum necessary extent your data may be transferred to a third country outside the European Economic Areas (EEA), where the data may be less protected than in the EEA. We make every effort to ensure that the transfer is carried out in a safe and controlled manner.

          Your rights

You have the right to access and correct your data, delete it, restrict processing, the right to object to processing and the right to the data transfer (the right to the data transfer does not apply to the data constituting a trade secret).

You can withdraw your consent at any time (this will not affect the legal use of your data until the consent is withdrawn).

The scope of each of these rights, the situations in which they can be exercised, and the way the law is applied arise from the legal provisions. Which of the rights you can use depends, in particular, on the purpose and legal basis of your personal data processing.

You also have the right to file a complaint to the supervisory authority.
